EUR 1.500 fine for those who break lockdown
rules and travel to Spain's second home!
In order to make warnings of infringement
more consistent, further guidance was provided to the Spanish security forces.
The Spanish Minister of the Interior has
issued a guide for the state security forces in an effort to standardize
standards when issuing fines for infringing the coronavirus warning confinement
decreed. One of the most remarkable is a fine of 1.500 euros for unauthorized
visits to a second home.
Violation of Spain's state of containment
creates some controversy, particularly as the state security forces, such as
the local police, should act. This is why the Spanish Ministry of the Interior
issued a guide for the National Police, the Civil Guardia and regional police
forces, to act equally and make fines more consistent.
Any unauthorized movement, the minimum amount
referred to in Article 36.6 of the Law on Public Safety, is subject to a
penalty of at least EUR 601. If there is a repeated offense from this point on
or contempt for a policeman is expressed, the penalty will be increased to
€2,000 and in case of intimidation, the penalty further increases to €3,000.
The highest penalty, for violence or threats that are not criminal, is up to
EUR 10,400.
The most frequent offenses referred to by
the authorities include the unauthorized movement to a second residence or a
holiday home where a fine of EUR 1.500 has been granted. In addition, the
carriage in a vehicle of minors, the elderly or those in vulnerable conditions
will also incur a fine of €1.500. The same penalty applies for unauthorized
"company" journeys.
The most serious fine can also be imported
on the organization or participation in communal events, such as celebrations,
as well as on violence or threats against police officers and a proposed
penalty of EUR 10.400 if it is considered high risk.
